Effective date: November 3, 2026
These Terms & Services ("Terms") govern your access to the website kirstieleephotography.com (the "Site") operated by Kirstie Lee Home Improvements ("we," "us," or "our") and your use of our home improvement, renovation, repair, and maintenance services (collectively, the "Services"). By visiting the Site, submitting a form, or engaging us for work, you agree to these Terms. If you do not agree, please do not use the Site or Services.
1. Eligibility and Accounts
You represent that you are at least eighteen years old and have the authority to enter into contracts for the property where work will be performed. Information you provide must be accurate and kept current. We may refuse or discontinue Service if information is false, misleading, or incomplete.
2. Nature of Services
Kirstie Lee Home Improvements provides residential and light commercial handyman visits, plumbing support, painting, carpentry, flooring, kitchen and bathroom remodeling, and related construction activities. Scope, materials, labor, schedule, and pricing are defined in written estimates, work orders, or maintenance agreements approved before work begins unless emergency stabilization is requested and authorized verbally with follow-up documentation.
Some tasks require licensed specialty contractors. When licensed partners perform work, their licenses, warranties, and insurance apply to their portion of the project. We coordinate scheduling and communication but are not responsible for delays caused by third-party inspectors, suppliers, or permit authorities.
3. Estimates, Pricing, and Payment
Published visit packages and pricing pages show starting rates for defined labor blocks. Custom projects require individualized quotes based on measurements, access, finishes, and code requirements. Estimates expire after thirty days unless otherwise stated. Material costs may change if you alter selections or if suppliers adjust prices before purchase.
Payment terms appear on your proposal. Deposits for custom projects reserve crew time and may fund material orders. Balances are due upon milestones or completion as specified. Late payments may pause work and incur reasonable administrative fees where permitted by law. We accept payment methods listed on your invoice.
4. Scheduling, Access, and Site Conditions
You agree to provide safe access to work areas, utilities, and parking as reasonably needed. Notify us of hidden conditions such as asbestos, lead paint, mold, faulty wiring, or structural damage. Discovery of hazardous or concealed conditions may require scope and price revisions after consultation.
Weather, supply chain delays, or permit inspections may shift schedules. We will communicate revisions promptly and resume work as soon as practical.
5. Change Orders
Changes requested after approval require a written or emailed change order describing added or removed work, cost impact, and schedule effect. We will not perform out-of-scope tasks without authorization. Minor adjustments that do not materially affect price or timeline may be documented in daily logs.
6. Warranties and Disclaimers
We warrant workmanship for the period stated on your completion documents, typically ninety days for visit packages and longer for specified remodel components. Manufacturer warranties apply to products we supply; you must register products when required. Warranty claims must be reported promptly with photos and descriptions.
Warranty does not cover damage from misuse, modifications by others, normal wear, acts of nature, or failure to maintain surfaces. We disclaim implied warranties to the fullest extent permitted by law beyond our written workmanship guarantee.
7. Limitation of Liability
To the maximum extent allowed by applicable law, our total liability for any claim arising from the Services or Site shall not exceed the amount you paid us for the specific project giving rise to the claim during the twelve months preceding the event. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility.
8. Indemnification
You agree to indemnify and hold harmless Kirstie Lee Home Improvements, its officers, employees, and subcontractors from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, inaccurate property disclosures, or disputes with neighbors, HOAs, or tenants related to work you authorized.
9. Website Use and Intellectual Property
Site content, including text, graphics, logos, images, and layout, is owned by or licensed to us and protected by intellectual property laws. You may view and print pages for personal, non-commercial use. You may not scrape, mirror, frame, or redistribute content without written permission.
Project photos taken by our team may be used in portfolios and marketing unless you opt out in writing before photography occurs. We will not publish your name without consent.
10. Communications and Electronic Records
By submitting forms on the Site, you consent to receive responses by email regarding inquiries, scheduling, and marketing if you subscribe. Marketing messages include unsubscribe options. Transactional messages related to active projects may still be sent after marketing opt-out.
11. Third-Party Links and Tools
The Site may reference third-party websites or social platforms for convenience. We do not control and are not responsible for their content, policies, or practices. Access them at your own risk.
12. Prohibited Conduct
You agree not to misuse the Site, including attempting unauthorized access, introducing malware, harvesting data, impersonating others, or using automated systems that impose unreasonable load. You will not use our Services for unlawful purposes or in violation of building codes, HOA rules, or rental agreements you are bound to follow.
13. Termination
We may suspend Site access or decline future Service for conduct that violates these Terms, creates safety risks, or involves abusive behavior toward staff. You may cancel scheduled visits according to the cancellation policy on your confirmation. Custom contracts may include separate termination and refund provisions.
14. Dispute Resolution
We prefer to resolve concerns informally. Contact us by email with a detailed description of the issue. If informal resolution fails, disputes shall be handled under the governing law section below, and parties agree to attempt mediation before litigation where practical.
15. Governing Law
These Terms are governed by applicable local and national laws where our business is registered, without regard to conflict-of-law principles. Courts with competent jurisdiction shall hear disputes unless mandatory consumer protections specify otherwise.
16. Severability and Entire Agreement
If any provision is found unenforceable, remaining provisions remain in effect. These Terms, together with signed proposals and policies referenced herein, constitute the entire agreement regarding Site use unless superseded by a signed project contract with conflicting terms, in which case the signed project contract controls for that project.
17. Updates
We may revise these Terms by posting an updated version on the Site with a new effective date. Continued use after changes constitutes acceptance. Material changes to active project contracts require mutual written agreement.
18. Contact
Questions about these Terms may be sent to hello@kirstieleephotography.com. We aim to respond within five business days.
